Skilled Nominated visa (subclass 190)

Features
​This visa is for points-tested skilled workers who are nominated by a state or territory government agency.
It allows you to live and work in Australia as a permanent resident.

Requirements
You might be eligible to apply for this visa if you were invited. When we sent you your letter of invitation, you must also have:
  • nominated an occupation that is on the relevant skilled occupation list
  • obtained a suitable skills assessment for that occupation
  • not yet turned 50 years of age
  • achieved the score specified in your letter of invitation based on the factors in the points test
  • at least competent English
  • been nominated by an Australian state or territory government agency.

To be able to apply for this visa, you must first submit an expression of interest and then be invited through SkillSelect. If you receive an invitation, you will have 60 days to apply online for the visa. During that time, you cannot change the information in your expression of interest.
When you have submitted your expression of interest, a state or territory government can examine it and decide whether to nominate you to apply for a visa. State and territory authorities have their own criteria for deciding who to nominate. Each state or territory government agency have different processes for nominating expressions of interests, some will contact you first and others may wait for you to contact them. You will be able to find more information on their websites.
Your visa application is likely to require extensive supporting documents, as listed in the document checklist. Start compiling your documents early in the process, even before you lodge your expression of interest.
Your passport
You need a valid passport or other travel document for this visa. If you plan to get a new passport, you should do so before applying for your visa. If you get a new passport after you have lodged your application, give the details of your new passport to one of our offices.
You might be able to update your passport details using ImmiAccount.
State and territory government agencies can view your expression of interest in SkillSelect and decide whether to nominate you for a visa. Each state or territory has a list of occupations that guides the types of skills they are looking for.
In your expression of interest, you can indicate your interest in just one state or territory, or you can choose to be available to all of them. If you accept a nomination, the states and territories may require you to:
  • live in the nominating state or territory for a specified minimum time
  • tell the state or territory your address, both before and after you arrive in Australia
  • be prepared to complete surveys and providing other post-arrival information they ask for
  • meet any of their other requirements.
Each state or territory government agency has its own process for nominating expressions of interest. Some agencies contact people directly and others wait for people to contact them. You can find more information on their websites.

Second instalment
You must pay a second instalment for each family member included in your application who:
  • is aged 18 years or older
  • has less than functional English.

How can I prove I have functional English?

To prove that you have functional English you must provide evidence of one of the following:
  • You are the holder of a valid passport issued by the United Kingdom, the United States of America, Canada, New Zealand, or the Republic of Ireland and you are a citizen of that country.
  • An International English Language Testing System (IELTS) test result of an average band score of at least 4.5 based on the four test components of speaking, reading, listening and writing. Your test must have been completed within 12 months of visa application lodgement or can be completed during visa application processing.
  • A Test of English as a Foreign Language internet-based Test (TOEFL iBT) test result of a total band score of at least 32 based on the four test components of speaking, reading, writing and listening. Your test must have been completed within 12 months of visa application lodgement or can be completed during visa application processing.
  • A Pearson Test of English (PTE) Academic test result of an overall band score of at least 30 based on the four test components of speaking, reading, writing and listening. Your test must have been completed within 12 months of visa application lodgement or can be completed during visa application processing.
  • A Cambridge English: Advanced (CAE) test result of an overall band score of at least 147 based on the four test components of speaking, reading, writing and listening and the test must have been taken on or after 1 January 2015. Your test must have been completed within 12 months of visa application lodgement or can be completed during visa application processing.
  • A positive assessment by an Adult Migrant English Program service provider in Australia that you have functional English.
  • Completed all years of primary education and at least three years of secondary education in an educational institution in or outside Australia and all instructions were in English.
  • Completed at least five years of secondary education in an institution in or outside Australia and all instructions were in English.
  • Successfully completed at least one year of full-time study or equivalent part-time study towards a degree, higher degree, diploma, or associate diploma in an institution in Australia and all instructions were in English.
  • Completed a degree, a higher degree, a diploma or a trade certificate that required at least two years of full-time study or training in an institution in or outside Australia and all instructions were in English.
  • The functional level of the Australian Assessment of Communicative English Skills (ACCESS) test certified by the relevant testing body. Your test must have been completed within 12 months of visa application lodgement or can be completed during visa application processing.

It allows you to live and work in Australia as a permanent resident.

1. 如果您持有下列签证和条件,那你将不可在澳大利亚境内申请和820类别临时和801永居配偶签证:
-未持有实质性签证(实质性签证不是过桥签证(Bridging visa A BCDE)或犯罪司法签证(Criminal Justice visa)或您之前的签证已被停止;

对于那些已经以学生临时签证身份在澳洲读书,如果在允许居留期间双方结婚了,也可以在澳洲以配偶的身份加入主申请人的独立技术移民签证,但要受到详细审查。有时也会受到突击捡查。

对于配偶签证担保的时间限制:
除非有部长的批准,担保人一生只能担保或被担保两次。并且,原有担保人若再离婚或分居,必须有5年的等待期来递交新的配偶担保申请。如果任何人被以配偶签证担保来澳大利亚,则需在之前的配偶签证通过后的5年后才能递交新的配偶担保申请。也就是说,原担保人和成功申请人都有5年等待期,才能担保下一个新的配偶。

父母一方担保移民后与其原配偶的担保移民的时间限制:
如果只有一位父母被子女担保移民澳大利亚,其只能在获得父母签证的5年后才能担保其配偶移民。换句话说,包括2年的父母签证的等待期,父母需等待7年才能为其原配偶递交配偶签证申请。不过,如果子女再次以父母移民方式申请他们来移民澳洲,则没有时间的限制。

长期配偶关系:
如果申请人和担保人有一名不小于2岁的共同子女(非收养或一方的子女)并且其配偶关系已超过3年时间。在这种情况下,申请人可以考虑申请直接永居100类别签证或801类别永居签证,而不须先经两年过临居签证这途径。

通常309签证将需经历2年的考验期才可授予100永居签证。在2年时间结束之前,部长有权拒绝100永居签证申请。部长还有权在2年时间结束之前授予此永居签证,但须满足下列3种情况:
-担保配偶在这期间死亡;
-在关系中出现相关的家庭暴力;
-申请人和担保人面临特定的法庭令,比如与孩子的抚养有关的法庭令。

新的配偶签证的申请已没有经济担保这回事,但更重要的是申请配偶签证的担保人却一定要能满足其担保承诺。 目前来看,作为一个符合条件的配偶签证担保者, 担保人必须能证明其有财政能力来支持其生活在澳大利亚的配偶。欲证明担保人有财政能力来支持其配偶, 其应:

1. 在澳大利亚有稳定的工作和收入, (由雇佣证明和退税单来证明);

2. 具有自有或租赁房屋来为配偶提供住宿;

3. 如果担保人已退休, 那么其需证明其有足够的退休金和合适的住所来支持其配偶, 或其具有足够的存款来支持配偶;


4. 如果担保人已经退休并没有存款收入, 其必须证明其有自有的房屋给配偶提供住所, 配偶会讲英文并且有工作或教育学历,将能很快的在澳洲找到合适的工作。
